Terms of Service

These terms govern your use of the SUFX mobile application and any related services (collectively, the “Service”). By using the Service you agree to these terms.

SUFX is operated by Ilia Gavrichenko, a private individual based in Hungary.

Eligibility

You must be at least 13 years old, or the minimum age required by the laws of your country (16 in Hungary and most of the EU under GDPR Article 8), to use the Service. If you are under 18, you must have a parent or guardian’s permission.

Your account

You are responsible for keeping your credentials secure and for activity that happens under your account. Notify us immediately at [email protected] if you suspect unauthorised access.

Licence to use the app

SUFX grants you a personal, non-transferable, non-exclusive licence to install and use the application on devices you own or control, for non-commercial personal learning. You may not redistribute, reverse-engineer, or resell the application or its content, except to the extent allowed by applicable law.

Acceptable use

You agree not to use the Service to:

• violate any law or third-party right;
• attempt to access other users’ accounts or data;
• interfere with the operation of the Service (e.g. by scraping at volume, injecting code, or running automated abuse);
• create multiple accounts to circumvent quotas, free-trial eligibility, or pricing restrictions;
• share your account credentials with others, or allow others to use your account;
• access the Service through means designed to bypass technical protection measures, including rate limits, daily quotas, or device-attestation checks.

Dictionary Database and prohibited uses

SUFX has invested substantial resources in selecting, verifying, and arranging the vocabulary content delivered through the Service, including but not limited to lexical units, definitions, etymologies, learning tips, synonym-difference explanations, mnemonics, examples, collocations, and other curated metadata (the “Dictionary Database”). The Dictionary Database is protected under EU Directive 96/9/EC (sui generis database right), copyright laws of Hungary and the European Union, and equivalent laws of other jurisdictions.

You may not, and you may not authorise any third party to:

• extract, reproduce, store, or redistribute the Dictionary Database or any substantial portion thereof, whether by manual or automated means;
• use the content of the Dictionary Database, in whole or in part, to train, fine-tune, evaluate, or otherwise develop machine-learning, large-language, or artificial-intelligence models, datasets, or evaluation benchmarks;
• create derivative works — including other dictionaries, language datasets, flashcard sets, or learning applications — based on the Dictionary Database;
• reverse-engineer the SUFX API, GraphQL schema, mobile-application bundle, or internal data structures, except as expressly permitted by applicable mandatory law (e.g., for interoperability under Directive 2009/24/EC Article 6);
• access the Service through automated means (bots, scrapers, headless browsers, API clients other than the official SUFX mobile application distributed through the Apple App Store or Google Play), except as expressly authorised in writing.

Each violation may result in: (i) immediate account suspension or termination, (ii) civil action for damages and injunctive relief, including under Directive 96/9/EC Article 7, and (iii) notice to platform operators (Apple App Store, Google Play, hosting providers) for take-down of derivative products. Sui generis protection lasts 15 years from the completion of the Dictionary Database and re-starts whenever substantial new investment is made (Directive 96/9/EC Article 10).

User content

You retain ownership of the text and notes you create in the Service. By using features that submit your text to AI assistants (Ask AI, essay feedback), you grant SUFX a limited licence to process that text strictly to provide the requested feature.

AI-generated content

Features that use artificial intelligence (Ask AI, essay feedback, automatic translation, generated explanations) may produce inaccurate, incomplete, biased, or fabricated output. AI output is provided for educational and self-study purposes only. It is not professional advice — in particular, you should not rely on AI output for medical, legal, financial, psychological, or safety-critical decisions. Always verify AI-generated information against authoritative sources before acting on it.

Subscriptions

Paid features are governed by the Subscription Terms, which form part of these terms.

Termination

You may delete your account at any time per the Account Deletion Policy. We may suspend or terminate your account if you materially breach these terms.

Disclaimers

The Service is provided “as is” without warranties of any kind. SUFX is an educational tool; we do not guarantee proficiency outcomes.

Limitation of liability

To the maximum extent permitted by law, SUFX is not liable for indirect, incidental, or consequential damages arising from your use of the Service.

Indemnification

You agree to indemnify and hold SUFX harmless from any third-party claim arising from your breach of these terms or your violation of any law or third-party right.

Force majeure

SUFX is not liable for delays or failures resulting from events beyond its reasonable control (acts of God, government action, network failures, third-party infrastructure outages).

Governing law and jurisdiction

These terms are governed by the laws of Hungary, excluding its conflict-of-laws rules. Mandatory consumer-protection rules of your country of residence within the EU/EEA remain unaffected. EU/EEA consumers may bring claims in the courts of their country of residence under Regulation (EU) 1215/2012, Articles 17–19.

Severability

If any provision of these terms is found unenforceable, the remaining provisions remain in full effect.

Entire agreement

These terms, together with the Privacy Policy and Subscription Terms, constitute the entire agreement between you and SUFX with respect to the Service.

Changes

We may update these terms. The current version is always available at /legal/terms-of-service. Continued use of the Service after changes constitutes acceptance.

Apple App Store: additional terms

These additional terms apply when you obtain SUFX from the Apple App Store, as required by the Apple Developer Program.

1. Acknowledgement. These terms are concluded between you and SUFX, not Apple. Apple is not responsible for the application or its content.
2. Scope of licence. The licence granted to you for SUFX is a non-transferable licence to use the application on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
3. Maintenance and support. SUFX is solely responsible for any maintenance and support. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to SUFX.
4. Warranty. SUFX is solely responsible for any product warranties, expressed or implied by law, to the extent not effectively disclaimed. In the event of any failure of SUFX to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to SUFX.
5. Product claims. SUFX, not Apple, is responsible for addressing any claims relating to SUFX or your possession and use of it, including (i) product-liability claims, (ii) any claim that SUFX fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer-protection, privacy, or similar legislation.
6. Intellectual-property rights. In the event of a third-party claim that SUFX or your use of SUFX infringes that third party’s intellectual-property rights, SUFX, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
7. Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a US government embargo or that has been designated by the US government as a “terrorist-supporting” country, and (ii) you are not listed on any US government list of prohibited or restricted parties.

9. Third-party terms. You must comply with applicable third-party terms of agreement when using SUFX.
10. Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary thereof.
